1. Acceptance of these Terms

These Terms of Service ("Terms") govern your use of Hush Stories, including the mobile app, website, content, and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Who may use Hush Stories

You may use the Service only if:

  • you can form a binding agreement under applicable law
  • you comply with these Terms and applicable laws

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

3. What Hush Stories provides

Hush Stories is designed to provide sleep stories, bedtime listening, calming audio, personalization, and related wind-down experiences.

The Service may include:

  • story playback
  • favorites or saved content
  • listening-progress features
  • reminder or notification features
  • personalization and preference flows
  • content or feature access that may vary by account or entitlement status

4. Not medical advice

Hush Stories is a wellness / media product, not a medical service.

The Service does not provide:

  • medical advice
  • diagnosis
  • treatment
  • emergency or crisis support

Do not rely on Hush Stories as a substitute for professional medical or mental health care. If you have concerns about insomnia, a sleep disorder, mental health, or another medical issue, consult a qualified professional.

5. Accounts and access

Hush Stories currently uses a lightweight account/session model for many app flows, including anonymous accounts created through the app's authentication flow.

You are responsible for:

  • maintaining the security of your device and any credentials or tokens associated with your use of the Service
  • activity that occurs through your use of the Service
  • providing accurate information if you later choose to attach contact or account details

We may limit some features to certain account types, environments, or entitlement states.

6. Permitted use

You may use the Service only for personal, lawful, non-commercial use unless we clearly authorize broader use in writing.

You agree not to:

  • copy, resell, redistribute, or publicly exploit the Service or its content except as allowed by law or written permission
  • interfere with or disrupt the Service
  • attempt unauthorized access to systems, accounts, or data
  • reverse engineer, scrape, or automate against the Service in a way that violates applicable law or these Terms
  • use the Service to violate another person's rights
  • upload, send, or introduce malicious code, abusive traffic, or harmful content

7. Content and intellectual property

Unless otherwise stated, the Service and its contents - including app code, branding, text, designs, artwork, audio, and story content - are owned by Hush Stories or its licensors and are protected by applicable law.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal use in accordance with these Terms.

If you send feedback, ideas, or suggestions, we may use them without restriction or compensation, unless applicable law requires otherwise.

8. Notifications and reminders

If you enable reminders or notifications:

  • you consent to receiving them subject to your device settings
  • delivery may depend on third-party platforms and device behavior
  • we do not guarantee exact timing, successful delivery, or uninterrupted notification service

9. Premium access, paid features, and store rules

Some content or features may depend on account status, preview status, or other entitlement rules.

If Hush Stories offers paid features, subscriptions, or in-app purchases now or later:

  • pricing and billing terms will be disclosed at the time of purchase
  • Apple App Store or Google Play rules may govern billing, renewals, cancellations, and refunds
  • any purchase-specific terms shown at checkout will supplement these Terms

If a feature is marked premium or restricted, you may not bypass or interfere with those access controls.

10. Third-party services

Hush Stories may rely on or link to third-party services such as Apple, Google, Expo, Firebase, Supabase, hosting providers, and related infrastructure or support providers.

Your use of those services may also be governed by their separate terms and policies.

11. Availability and changes

We may:

  • modify the Service
  • add or remove features
  • change technical requirements
  • suspend, limit, or discontinue part of the Service

We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free, or that it will work on every device or configuration.

12. Termination

We may suspend or terminate access to the Service if:

  • you violate these Terms
  • your use creates risk, harm, abuse, or legal exposure
  • we are required to do so by law

You may stop using the Service at any time.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, governing law, and dispute-related provisions.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUSH STORIES AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR
  • USD $50

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Governing law and disputes

Except to the extent applicable law requires otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

You and Hush Stories agree that any dispute arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in California, and each party consents to personal jurisdiction and venue there.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we may update the date above and provide notice where appropriate.

Your continued use of the Service after updated Terms take effect means you accept the updated Terms.
